These Terms of Use ("Terms") govern your use of the RateGuard watchOS application ("the app"). By installing or using the app, you agree to these Terms.

Not Medical Advice

RateGuard is a fitness and training tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. Heart-rate readings and zone alerts are intended for informational and training purposes only. If you have any condition that may be affected by physical exercise, or if you experience symptoms during exercise, consult a qualified healthcare professional before relying on RateGuard or any consumer heart-rate monitor.

Apple Watch and HealthKit

RateGuard uses Apple's HealthKit framework and the Apple Watch heart-rate sensor. The accuracy and availability of these readings are determined by Apple's hardware and operating system. RateGuard cannot guarantee continuous data or alert delivery in all conditions; alerts may be missed if the watch is removed, if HealthKit access is revoked, or if the workout session is interrupted by the operating system.

License

Subject to these Terms, you are granted a non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the app, except to the extent these restrictions are prohibited by applicable law.

No Account, No Payments

RateGuard does not require an account, does not transmit your data to remote servers, and does not currently process payments through the app.

Acceptable Use

You agree to use the app only for lawful, personal, non-commercial purposes. You agree not to use the app in a manner that could damage, disable, overburden, or impair any Apple service the app relies on.

Disclaimers

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Your use of the app is at your own risk.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event will RateGuard, its developers, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or use, arising out of or in connection with your use of the app.

Changes to These Terms

We may update these Terms from time to time. Continued use of the app after a change takes effect constitutes your acceptance of the revised Terms.
